Our Efforts Are Gaining Momentum! TV Next UPDATE

Tierra Verde NEXT has made major strides in the fight against Greenleaf’s proposed expansion of Tierra Verde Marina. What began as a challenge to development approval has grown into a coordinated legal and regulatory effort. Our involvement now spans multiple agencies and permitting issues.

This update is to share details and ask for your continued support.

After months of analysis, legal work and agency outreach, TV NEXT has identified many weaknesses in the project that were not apparent at the beginning that Greenleaf must now address.

The momentum has shifted in our favor. Serious issues for Greenleaf include:

• Circuit Court Challenge: Our case has grown stronger since filing, as our attorneys have been developing and amending the case to address additional issues. The court challenge enables us to attack the project’s underlying site-plan approval.

• FWC / Manatee Review: Through our indirect efforts, Florida Fish and Wildlife has raised serious concerns about increased marina intensity at this location. FWC indicated it cannot recommend an increase in slips, even for dry storage. This supports one of our central arguments: the island is an inappropriate location for this project.

• SWFWMD Review: We continue to challenge Greenleaf’s effort to label this substantial redevelopment as a minor modification. We believe this should be considered a MAJOR modification, which would force re-examination. We support SWFWMD’s efforts to raise questions involving stormwater, pervious-area calculations and the proper baseline against which the proposed development must be evaluated.

• FDEP Submerged Lands Lease (SLL): Based on our research, the Department of Environmental Protection is investigating the current marina. An initial site inspection found Greenleaf to be out of compliance on public access and other requirements. The requirements exist independently of the City’s recent approval; they dictate that 90% of the wet slips remain available to the general public. The DEP investigation is ongoing.

• Existing Parking and Site-Plan Issues: We are pursuing code-compliance objections to the current storage of boats and racks in areas designated for automobile parking and the operational impacts of outdoor storage, including forklift operations adjacent to neighboring residences.

• Federal Review: We are prepared to participate in the U.S. Army Corps of Engineers process and insist that regulators evaluate the complete project and its cumulative impacts, rather than viewing individual components in isolation.

Greenleaf must successfully navigate the Circuit Court, the challenge to DRC parking concessions, FWC, SWFWMD, DEP, federal permitting and other regulatory issues before this project can move forward as proposed.

TV NEXT does not have to prevail on every issue. One major setback can force Greenleaf into additional agency reviews or require them to redesign or resize this project. An agency or court action can prevent the development from going ahead as currently approved.

Having strong arguments is not enough; we still need substantial help to continue the fight.

We need more resources to continue!

Legal filings, amended arguments, agency submissions, hearings, expert reviews, and responses to Greenleaf filings all require significant legal work.
